OLD BUSINESS
  • Shaker Hill Nursery – Chairman Duchette brings up that the biggest issue is whether or not items can be displayed in the setbacks.  Member Porter explains that in his mind they are not having storage it is saleable goods because they are there temporarily.  Robert Faunce is talking about it being a change in use and it requires site plan approval.  Chairman Duchette states that what they are doing was before the ordinance and it was a retail entity prior to the ordinance and it is not a dramatic use change.  Member Porter states that as long as the impervious zones haven’t changed then he doesn’t see a problem.  Consensus of the board that kayaks and retail displays are allowable in the setback zones, Foster says NO – Willett says YES – Carl says YES – George says NO – Jim says YES.  Change of use in an application has been requested but they will be held to the standards that were previous.  Every night the items allowed in the setback need to be removed.  They will need to come before the board to present the application, no drainage… site plan add setbacks.
